These Terms of Service (“Terms”) govern mondsubs.com and purchases from AVERLANE COMMERCE INC, doing business as MONDSUB (“MONDSUB,” “we,” “us,” or “our”). By using the site or placing an order, you agree to these Terms.

1. Eligibility and Information

You must be able to form a binding contract. You agree to provide accurate account, billing, shipping, and contact information and to protect your credentials. You are responsible for account activity unless caused by our failure to use reasonable security.

2. Products, Prices, and Promotions

We make reasonable efforts to describe and display products accurately, but colors, appearance, and measurements may reasonably vary. Prices, discounts, shipping charges, and taxes shown at checkout apply to the order. Promotions follow their stated terms. An obvious pricing, inventory, or technical error does not require fulfillment on erroneous terms; if payment was captured and we cancel, we will promptly refund the affected amount.

3. Orders and Payment

Your order is an offer to purchase. An order confirmation acknowledges receipt, while acceptance occurs when we send a shipping confirmation or fulfill the order. We may reject or cancel for legitimate reasons such as unavailable inventory, suspected fraud, payment failure, an address we cannot serve, legal restrictions, or an obvious error. We will notify you and refund collected amounts for cancelled items.

You authorize us and our payment providers to charge the total shown before order submission. We may use payment and fraud-prevention providers to verify identity, device, address, and order information and may request reasonable verification before fulfillment. We do not receive or store the full card number when it is processed by a third-party provider.

4. Shipping and Delivery

Shipping eligibility, charges, processing, estimates, address changes, tracking, damage, loss, and packages marked delivered are governed by our Shipping Policy. Carrier handoff, scans, photographs, or signatures may be considered when investigating a claim but do not eliminate rights that cannot lawfully be limited. If we cannot ship within the promised time, we will provide any notice and cancellation or refund option required by law.

5. Returns, Refunds, and Problems

Returns, exchanges, cancellations, damaged or incorrect items, missing packages, and refunds are governed by our Refund and Return Policy. Nothing in these Terms limits a non-waivable consumer right. Contact hello@mondsubs.com promptly so we can investigate and offer the appropriate remedy.

6. Chargebacks and Payment Disputes

If you do not recognize a charge or believe there is an order problem, contact us first when practical. Filing a chargeback does not create an automatic right to keep both the merchandise and the purchase funds. We may give the card issuer relevant checkout disclosures, communications, fraud-screening results, fulfillment records, tracking, delivery scans, photographs, signatures, and refund history. The issuer decides the dispute under its rules. This does not restrict a lawful dispute of an unauthorized or improper charge.

7. Reviews and Acceptable Use

Content you submit must be yours to share and must not be unlawful, deceptive, infringing, abusive, or harmful. You grant us a non-exclusive, worldwide, royalty-free license to use and display it for operating and promoting MONDSUB, subject to applicable privacy law; you retain ownership. We may remove violating content.

You may not use the site to violate law, infringe rights, transmit malware, disrupt service, submit false information, impersonate another person, defeat security, scrape in an abusive manner, or commit fraud. We may suspend access reasonably necessary to protect customers, the site, or legal rights.

8. Intellectual Property and Third Parties

The site, branding, text, graphics, photographs, and layout are owned by or licensed to us and protected by law. You receive only a limited, revocable, non-transferable right to use the site for personal shopping.

Our store is hosted by Shopify and may use third-party payment, analytics, advertising, support, and logistics services. Third-party sites and services have their own terms and privacy practices. We are not responsible for third-party conduct outside our reasonable control, but this does not limit obligations we owe as the seller.

9. Privacy

Our handling of personal information is described in our Privacy Policy. Shopify may also process information under its own consumer privacy notice.

10. Disclaimers and Liability

To the maximum extent permitted by law, the site is provided on an “as available” basis, and we do not promise uninterrupted or error-free access. Products remain subject to any express warranty stated on the product page and all non-waivable warranties and protections.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential losses that were not reasonably foreseeable. For a purchase claim, our aggregate liability will not exceed the amount paid for the affected order unless law requires a greater remedy. No term excludes liability for fraud, willful misconduct, gross negligence, personal injury caused by negligence, or anything else that cannot legally be excluded.

11. Governing Law and Disputes

Washington law governs these Terms without regard to conflict-of-law rules, but this does not deprive you of mandatory protections in your state of residence. The parties should first try in good faith to resolve a dispute. A claim may be filed in any court with lawful jurisdiction. These Terms do not require arbitration or waive a class-action right where it cannot lawfully be waived.

12. Changes and General Terms

We may update these Terms prospectively by posting a revised date. The Terms in effect when an order is placed govern that purchase unless law requires otherwise. If a provision is unenforceable, the rest remains effective. Failure to enforce a provision is not a waiver. You may not transfer your obligations without our consent; we may transfer ours as part of a legitimate business transaction without reducing your rights.
